Criminal Prosecution – Police not interested?

Following the article in the Daily Express on Monday 21st July 2003 and which highlighted the growing trend that UK police forces are no longer prepared to accept complaints (or indeed prosecute offenders) which relate to fraud (whether it be small scale or a substantial fraud), Kenyon Investigation Services (staffed by ex-C.I.D. officers), offer an alternative answer.

Private Criminal Prosecution Under the Theft Act 1968

There is nothing in UK law to prevent a company or individual from investigating a suspected fraud or theft, preparing a prosecution case and placing the matter before a court of law.

Procedure in such cases.

In such cases we at Kenyon Investigation Services would provide a free consultation interview, in order to review your concerns and recommend the correct course of action that should be taken.

Once a case has been referred to us and enquires are commenced, you the client would be kept up to date with any developments and you can cancel any action, at any time you wish.

As our staff are ex-police personnel and fully conversant with the procedure of criminal investigation, the gathering of evidence and the presentation of prosecution files to the court, we can provide a full service therefore ensuring that the offender is brought to justice.

Once a case has been investigated and a file of evidence has been compiled, information is laid before the court and summonses issued or offenders arrested. At this stage, our in house experienced prosecution solicitor would present the case before the court.

The “two pronged” attack.

Not only would a criminal prosecution be pursued, we would also seek to obtain as much information as legally possible regarding an offender, thus furnishing you with a pre sue report. Showing the lifestyle and assets of the subject in order to assist a civil action where damages are sought. When a criminal action has been successfully concluded, we would ask the court to award costs against the offender. Any costs awarded would be paid direct to you the aggrieved party.

Our Charges

Why consider instructing a solicitor to pursue the matter and be faced with a large bill, which would probably include hourly charges of up to £150 per hour?

Solicitors would more than likely pursue the matter through the civil courts in any case and whose powers are somewhat limited.

You have nothing to lose by picking up the telephone and speaking to one of our investigators or arranging a free consultation at either your offices or a mutually suitable location.

Decision time

You the aggrieved person, who no doubt has suffered from placing your (or your companies) trust in a person and having suffered a financial loss, must now make a decision.

Here are the alternatives for your consideration:

Forget the whole situation and put the bad experience behind you allowing the offender to get away with matters.
Consult a solicitor, who will no doubt pursue the matter via civil action, charge you the earth and at the end of the day get no where, does this sound familiar?
